I am happy to report court operations continue to move forward as we will anticipate increasing more in-person hearings as conditions improve. Civil and criminal jury trials are being conducted and every effort is being made to get cases to trial as quickly and smoothly as possible.
​
​Do not expect an immediate return to all dockets being handled in-person as it will be more of a gradual resumption. Look for further announcements to come regarding the ramp-up to more in-person hearings. We do expect remote hearings to continue even when the pandemic officially comes to an end with a final decision yet to be made as to which dockets and case-types will stay with remote hearings. In that regard, we await potential further Illinois Supreme Court guidance before making our local decisions.

For attorneys handling evictions, law minor and arbitration cases, please look for new policies and procedures sometime during the week of March 29, 2021 on the Circuit Clerk’s website. Mary will distribute to the Bar. In light of the February 10, 2021 Illinois Supreme Court Order in M.R. 30370, this docket will return to date-certain summons for all case-types as well as changes to which Initial Appearances will be in-person and ones that will remain remote. New “preferred” summonses will also be available through the McLean County Circuit Clerk website, along with the new policies and procedures. Motions for Default in these cases will no longer be accepted without a hearing due to the Supreme Court Order.

Please remember the 1st Bench/Bar Listening Session will be held Wednesday, March 31, 2021 beginning at 12.15 pm via Zoom. Please register below if you have not already done so. Judges will provide brief updates, will be available to answer procedural questions and look forward to hearing from the Bar. You are encouraged to submit questions in advance so that we can attempt to get answers during the session in the event the Judge that can best answer it won’t be available during the listening session.

This lunch time event is an opportunity to address fluid court situations as we progress through the ever changing landscape. The purpose of this visit is to provide all 'stakeholders' an opportunity to hear about pending changes. Those who are invited to attend include Judges, Attorneys, Staff and the Clerks Office.

to replace local forms

The Illinois Supreme Court approved amendments to Rule 10-101 regarding Standardized Court Forms proposed by the Illinois Judicial Conference.  These amendments recognize that standardized forms have played a significant role in the diminishment of the challenges faced by self-represented litigants (SRLs) and that increased use and availability of the standardized forms be encouraged.

​The amendments require that after a standardized court form is published, courts cannot have or use local forms for the same legal remedy. Also, all courts must promote the standardized court forms. The amendments are not effective until July 1, 2021. You can find the currently published standardized court forms at this LINK.

​Eviction Moratorium extended to April 3, 2021
​Rental Assistance

​The Illinois eviction moratorium is extended to April 3, 2021. People who are behind in their rent, mortgage, or utility payments should apply for assistance now. The best way to start this process is to call 211 to find out the best place to apply based on their unique circumstances. 
 
Currently, the most likely source of assistance is through the Town of Normal (if the person lives in Normal) or the City of Bloomington (if the person lives in Bloomington). Please see the flyer listed below under Eviction Resources. Please distribute it widely. If you have case management services, please provide tenants with assistance gathering documents so that they can submit a complete application. We have seen a majority of applications be rejected due to incomplete documentation.
 
People seeking assistance should not call me. They should call 211 or follow the instructions on the attached flyer. If you or your staff have any questions, please feel free to contact me.

In order to be considered for the award, one must be (1) under the age of 36 or less than 10 years in practice, and (2) a member in good standing with the McLean County Bar Association. Evaluation criteria include employment history, individual achievements in the practice of law, service to the MCBA, and community/pro bono service.​
