COURT NOTES
On a more technical side of things, I would encourage you to review the following new Illinois Supreme Court Rule and Order recently entered: 1. Revised Illinois Supreme Court Rule 10-101 (effective 7/1/21)—Use of Supreme Court Approved Forms: The Supreme Court continues to emphasize the use of its Approved Forms that can be found on the “Illinois Courts’ website under the “Documents” tab. You should also be able to access that website through a link on the McLean County Circuit Clerk’s website. You will also find local forms on the Circuit Clerk’s website patterned after the Supreme Court’s forms that have been tailored to local customs and practice. I am sure other forms will be added in due course. 2. Amended Illinois Supreme Court Order M.R. 30370 entered April 6, 2021---Eviction Proceedings: For those handling evictions, please familiarize yourself with this Order as it provides guidance on how those cases can currently proceed and what must be submitted at the time of filing to request a summons be issued. Lastly, for those handling AR/LM/SC cases, including evictions, please review the revised policies and procedures that were recently published in light of the Illinois Supreme Court’s decision to revert back to date-certain summonses after it temporarily allowed the use of 30 day summonses. We have adjusted our procedures and you are encouraged to reach out to me with questions or for a further detailed explanation. Those policies and procedures can also be found on the Circuit Clerk’s website. Alternatively, my assistant, Joy McKinney, can email you a copy. Lastly, please familiarize yourself with the “Preferred Summonses” on the website should you be handling those cases since it will impact whether your 1st appearance will be remote or in-person as those summonses have been tailored to our local court practices.
