Greetings from the Bar!  We are pleased that we didn’t see the post-Holiday Covid spike that has allowed us to continue adjusting court operations to allow jury trials to resume after a brief December pause. While we are also pleased that the current Covid metrics are improving, we don’t want to expand court operations prematurely. Therefore, we continue to

prioritize the individual dockets as we look to a return to more in-person hearings for those dockets that are not conducive to a remote format. There will be more information when decisions are made in that regard, but no one throughout the State is in any position to select a date now when to begin transitioning back to what we would consider (or remember) as “normal” operations. We appreciate the need to return to a fully functioning court system, but we must adhere to recommended health guidelines.

For those that handle eviction cases, you should familiarize yourself with Illinois Supreme Court Order M.R. 30370 entered December 22, 2020 [Order M.R. 30370 LINK] before filing your complaint to avoid cases being dismissed pursuant to that Order for non-compliance. You should also familiarize yourself with Illinois Executive Order 2020-72 (and related EO) concerning timing issues regarding the financial declaration and commencing the action by serving the notice to terminate tenancy.

Lastly, we will be welcoming Carla Barnes to the Bench on February 11, 2020 at 3 p.m. Due to the pandemic, her investiture proceeding will live-streamed by video link and the courtroom will be limited to Carla’s friends and family. Will has already sent the link through Mary Sellmyer’s 2-2-2021 email. Overflow seating will be available in the Jury Assembly Room where video screens will display the ceremony.

The Ins and Outs of Winning a Deferred Action for Childhood Arrivals (DACA) Case
​

Please join the McLean County Bar Association in welcoming Ms. Charlotte Alvarez. She will lead the Bar through a presentation on the DACA program which was created by President Obama in 2012. That program was suspended for the majority of the past four years. Thanks to a combination of Supreme Court litigation and executive policy changes, the program is once again open to new applicants, providing an exciting new path to work authorization and status for thousands of youth in our communities. In this CLE, you will learn the ins and outs of obtaining DACA status for clients, either in private practice or as a pro bono volunteer with The Immigration Project. ​

A February 11, 2021 swearing in ceremony is planned with an extremely small in-person attendance allowed. Information on the virtual swearing-in ceremony was emailed to membership on February 2.

Please join us on Thursday, February 11, 2021, for Learn@Lunch with our featured speaker, Attorney Thomas McClure. Professor McClure will present an overview of Illinois Eviction Law and he will explain how a landlord can terminate a lease. He will present the common defenses to eviction and will introduce standardized eviction forms. His presentation has been updated to include current rules and regulations pertaining to the Covid-19 pandemic. This presentation is eligible for one hour of paralegal CLE.
 
The CIPA Learn@Lunch series is available as a live webinar via the Zoom videoconferencing platform. A link to the videoconference will be provided upon registration. This webinar is available at no charge to current members and only $5.00 for non-members.

Illinois Law of Eviction

Please join the McLean County Bar Association in welcoming Mr. Thomas E. McClure, J.D., M.S. He will lead the Bar through a presentation on the current Evictions Law in Illinois. Mr. McClure will include topics such as lease formats and terms, breach of lease, service of notice, specific procedures for certain tenancies and tenants and filing suit. He will also review two forms including the 'Plantiff's Certification of Compliance with the Governor's Executive Order on Evictions' and the 'Declaration Under Penalty of Perjury for State of Illinois Executive Order 2020-72.'

Chief Judge Fellheimer will provide closing remarks on the current local Evictions situation.
