Law and McLean County: A 175 Year Partnership

Erin Duncan joined the firm in July 2021. She graduated from Lewis & Clark Law School in 2013 with a certificate in Public Interest Law and is now licensed in Illinois and Oregon. Before moving to Illinois in June, she practiced family law in Corvallis, Oregon, including dissolutions, custody, guardianship, adoption, and protective orders. Erin will help manage Prairie State’s courthouse eviction clinic and assist clients on a range of housing law issues. She is happy to be in Bloomington, engaging with community partners to serve vulnerable populations and prevent and address homelessness.

susan o'neal
Susan O'Neal joined Prairie State on June 1st as a staff attorney in the Justice, Equity, and Opportunity Program. She has been licensed to practice law in Illinois since 1990 and has dedicated her career to serving the poor and people with disabilities. Before joining Prairie State, Ms. O'Neal had been a Senior Attorney at Equip for Equality in Springfield. She is currently involved with the McLean County Re-Entry Council.
MCBA SCHOLARSHIP
If you know any law students, please inform them about the 2021 MCBA Community Service Scholarship. The $2,500 scholarship is open to second or third year law students with strong ties to McLean County, Bloomington-Normal, or its surrounding communities. Prime candidates will express and demonstrate a commitment to legal aid work, pro bono activities, or community service. The application deadline is October 31, 2021. protecting your client's medicare benefits
Many thanks to our own John Muir, JD and Mr. Craig Pawley who presented this original CLE on August 24, 2021. The CLE presentation covered settling cases with a Medicare beneficiary and understanding the Medicare Secondary Payer Statue. This session also covered addressing Medicare liens, Medicare Set Asides, and how to administer those funds while adhering to the CMS guidelines.

A DISCUSSION OF THE LANGUAGE USED IN THE APPOINTMENT ORDER
Many thanks to our own Hon. Donald Bernardi Circuit Judge (Retd.) and Hon. Amy McFarland who presented this original CLE on July 20, 2021. During this presentation, they made practitioners and Judges aware of the ways in which the GAL's may be subjected to liability and how the Courts may protect those who serve in court-appointed roles. In addition, the speakers will discuss the language used in these orders and provide suggested sample orders.

Please join the McLean County Bar Association in welcoming our own McLean County Probation Department. The Interstate Commission for Adult Offender Supervision (ICAOS) is a formal agreement between the states to oversee offender interstate travel and subsequent supervision. Within the ICAOS purview is the Interstate Compact Offender Tracking System, or ICOTS. ICOTS is the supervision system that probation officers use to send and receive information regarding defendants and their supervision cases between states. There are several different definitions and requirements that defendants must meet in order to be eligible for transfer to a receiving state. It is important that these requirements are known and understood in order to best assist a defendant who will be placed on supervision and subject to the conditions of an order.
The presentation will provide helpful definitions and rules that are commonly utilized when transferring a defendant to another state for supervision. There have been instances where a defendant was sentenced to probation with the belief that they would be transferred to their “home” state and then finding out that the state has rejected their request. It is the goal of our department to provide basic rules and regulations of the ICOTS system and answer any questions that others may have regarding the interstate transfer of their defendants.

This presentation will discuss the pleading requirements of an adoption petition in cases arising from Juvenile court and those that seek termination of parental rights (private adoption cases). The speakers will discuss notice requirements and the contents of the adoption judgment. In addition, there will be a discussion of evidentiary issues common to adoption hearings.
