To:  The McLean County Bar Association:

Just a quick update on Court operations.  Following is list of some of the main issues we are addressing as well as some upcoming events:

1.  The Judiciary and all justice stakeholders continue to meet, plan and organize for the implementation of the bond reform that largely takes effect on 1/1/23. Commonly known as the “Pre-Trial Fairness Act (PFA) and the “Safe T Act”, it provides a complete overhaul of the bond, bail and pre-trial practices and procedures. We are meeting on a regular basis to ensure everyone involved is aware of the significant coming changes. 
This is one of the largest
undertakings to date in terms of the Court devoting resources to the implementation of a new Legislative Act.

2.  Don Knapp will be sworn into office as the next Circuit Judge on Friday, September 16 at 3:00 pm. More details are listed below.


3.  A joint reception to thank Justice Rita Garman for her years of service and to welcome Justice Lisa Holder White will take place from 3:30 pm - 5:30 pm on Wednesday, September 28, 2022 at the McLean County Law & Justice Center. More details are listed below, but hopefully you can stop by to meet and greet the Justices.

4.  Circuit Judge Casey Costigan was recently elected as our next Chief Judge starting January 2023.  He will be a great leader and will continue to move the 11th Circuit forward to allow us to efficiently, effectively and fairly administer justice while continuing to be at the forefront of judicial advancements.

5.  On October 26, 2022, we will be hosting the next Bench/Bar Listening Session to provide court operation updates and to answer any questions related thereto. More details to come from Mary Sellmyer.

6.  While we’ve had some Covid cases at the Law & Justice Center recently, we have been fortunate that everyone has recovered and that we were able to continue uninterrupted court operations. We continue to monitor local health conditions and are hopeful that no changes to our operations will be necessary.

​A New Approach to Felony Murder in Illinois

[1 Hour General CLE Pending Approval]
In August of 2019, six teenagers drove to a rural area of Lake County, Illinois, in a stolen vehicle with the intention of burglarizing vehicles. Startled, the homeowner retrieved his gun, went out on the porch, and observed one of the teens approaching him, with what the homeowner determined to be a weapon. The homeowner fired his gun and killed one of the teens. The remaining five teens were charged with felony murder. At the time of this incident, Illinois applied the “proximate-cause theory” to felony murder. In response, the General Assembly amended the felony-murder rule with the intent to create an “agency theory.” However, the current version does not make this clear. It is possible that the proximate-cause theory would still apply and remain the most logical application of the law. Regardless, rather than attempting to abolish the proximate-cause theory, public concerns could have been addressed through amended sentencing provisions.

Learn the purposes and differences of the four most common personal protective orders, including Orders of Protection (OPs), Stalking No Contact Orders (SNCOs), Civil No Contact Orders (CNCOs), and Criminal Protective Orders (CPOs); who can be protected by the orders; the procedures for the filing and hearing of Petitions for these orders, including how emergency orders (EOPs, ESNCOs, and ECNCOs) are handled; the protective-order remedies available to victims of abuse/stalking/assault; plus some advanced practice tips that should help both the “newbie” and the “old pro” attorneys alike.
