I hope everyone had a nice and relaxing July 4th holiday. It seems as the years pass by the 4th of July comes upon us awfully fast.  I sure do hope the rest of the summer slows down a bit for all of us.

​I am happy to report that Court operations continue to progress despite the recent uptick in Covid cases. The Supreme Court is working on longer term remote hearings, and we await to see the final product. Locally, we continue to study the most effective ways to deliver justice both with remote and in-person hearings and that analysis is on-going and will continue forever.

​
We were fortunate to receive a grant for technology upgrades for every courtroom in the McLean County Law and Justice Center. The final touches are being performed now and we look forward to showcasing it all to you. A big thank you to our Trial Court Administrator, Will Scanlon, for getting this done. More information will follow on the integration of this new technology that will include how to better present your case in court with these new tools.

I hope you have a nice summer and look forward to seeing all of you.

I am participating in the Great Plains LIFE Foundation's 20 Stars for LIFE event to support the 'Stay 4' Project. 'Stay 4' is a local initiative designed to identify, help and retain low-income students who demonstrate the ability to succeed, yet are considered to be at risk of dropping out of high school. Upon completion of the program, students are awarded financial support as they pursue their college or technical education.

Once #1, the U.S. is now the only industrialized country where young people are less likely to graduate than their parents. Maintaining a qualified and competitive workforce is vital to keeping businesses and jobs in America afloat. Yet more than 2.5 million American high school students drop out every year. For the U.S. to remain a world leader, and competitive in the global economy, this must be changed.

A New Approach to Felony Murder in Illinois

1 Hour General CLE Pending Approval
In August of 2019, six teenagers drove to a rural area of Lake County, Illinois, in a stolen vehicle with the intention of burglarizing vehicles. Startled, the homeowner retrieved his gun, went out on the porch, and observed one of the teens approaching him, with what the homeowner determined to be a weapon. The homeowner fired his gun and killed one of the teens. The remaining five teens were charged with felony murder. At the time of this incident, Illinois applied the “proximate-cause theory” to felony murder. In response, the General Assembly amended the felony-murder rule with the intent to create an “agency theory.” However, the current version does not make this clear. It is possible that the proximate-cause theory would still apply and remain the most logical application of the law. Regardless, rather than attempting to abolish the proximate-cause theory, public concerns could have been addressed through amended sentencing provisions.

Learn the purposes and differences of the four most common personal protective orders, including Orders of Protection (OPs), Stalking No Contact Orders (SNCOs), Civil No Contact Orders (CNCOs), and Criminal Protective Orders (CPOs); who can be protected by the orders; the procedures for the filing and hearing of Petitions for these orders, including how emergency orders (EOPs, ESNCOs, and ECNCOs) are handled; the protective-order remedies available to victims of abuse/stalking/assault; plus some advanced practice tips that should help both the “newbie” and the “old pro” attorneys alike.
