We are pleased to welcome CHELP as the Adult Protective Services (APS) provider for McLean and Livingston counties, effective immediately. CHELP has served as the designated APS provider for DeWitt and Macon Counties since April 1, 1991.

Reports of suspected Abuse, Neglect, and Exploitation of older adults and adults with disabilities should be directed to CHELP at 1-217-422-9888 or 1-888-243-5701
 
CHELP will absorb all open APS cases. If you were coordinating with a case worker from PATH regarding an APS client, please direct all future communication to CHELP. The meeting will take place on the Epiphany Farm near Downs, Illinois. The meeting will commence at 4:30 pm on Thursday, June 16. 

This years agenda will include important business a summary of committee reports, a vote on open Board positions and the transition for the 2022-2023 term. This years agenda will also include the 2022 Young Lawyer of the Year Awards. The memorials will be honored for those who are listed below.

Pursuant to §9.2(a) of Article IX of the By-Laws of the McLean County Bar Association, the following have been slated as nominees for the below-named offices of the McLean County Bar Association for the 2022-2023 term:

Illinois Homeowner Assistance Fund 

The Illinois Homeowner Assistance Fund Program (ILHAF) provides financial assistance to qualified Illinois homeowners who have fallen behind on their mortgage and related housing expenses due to the COVID-19 pandemic. It is administered by the Illinois Housing Development Authority (IHDA) with funding provided to the State of Illinois under the American Rescue Plan Act of 2021, and IHDA will accept ILHAF applications from Illinois homeowners through Tuesday, May 31, 2022. Approximately $309 million in federal assistance is available to help homeowners at risk of default, foreclosure, or displacement.   

Impact of ILHAF on Foreclosure-Related Activities in Illinois 

To allow borrowers experiencing COVID-19 related hardships time to obtain this assistance, the Federal Housing Finance Agency (FHFA) has announced that Fannie Mae and Freddie Mac now require servicers to suspend foreclosure activities for up to 60 days if the servicer has been notified that a borrower has applied for ILHAF assistance.  

Effective immediately, servicers must suspend all foreclosure actions, including foreclosure sales, the initiation of any judicial or non-judicial foreclosure process, move for foreclosure judgment or orders of sale, for up to 60 days if: 
​

  • The servicer has been notified that the borrower has applied for assistance under ILHAF;
  • Any foreclosure proceeding or execution of a foreclosure sale can be delayed without dismissal of the action;
  • The servicer has sufficient time to suspend initiation of the foreclosure process or moving for a foreclosure judgment or order of sale; and
  • In the case of a foreclosure sale, the servicer is notified at least 7 days before the sale.
​

Guidance documents from Fannie Mae and Freddie Mac further note that if a servicer determines that it did not have sufficient time to suspend the foreclosure action, the servicer must document why it was unable to do so in the mortgage file and make that documentation available upon request. 
​

Learn the purposes and differences of the four most common personal protective orders, including Orders of Protection (OPs), Stalking No Contact Orders (SNCOs), Civil No Contact Orders (CNCOs), and Criminal Protective Orders (CPOs); who can be protected by the orders; the procedures for the filing and hearing of Petitions for these orders, including how emergency orders (EOPs, ESNCOs, and ECNCOs) are handled; the protective-order remedies available to victims of abuse/stalking/assault; plus some advanced practice tips that should help both the “newbie” and the “old pro” attorneys alike.
