1 or 2 hours OF GENERAL CLE CREDIT - APPROVED


Please join the McLean County Bar Association for an Evictions Act program presented by Hon. David W. Butler. This luncheon is a bit different in that Judge Butler will address a general overview and understanding of the tenant/landlord eviction process for the first hour. During the following hour, there will be a detailed case law discussion on the eviction process. A participant can choose to stay for one or both hours of the presentation. Both hours will include a practical application and reference for addressing the clients needs whether your practice addresses tenant/landlord issues on a continual or sporadic basis. ​

Program Schedule

The first hour - 'The Basics - Eviction Cases from Start to Finish'
*Explore Service of Process pitfalls to establishing the Court's jurisdiction.
*Learn the most common mistakes made by Landlords.
​*Learn the most common defenses to an eviction action.
​
*Learn the notice requirements that must be met before an eviction case can be filed.
*​Review the new Eviction Act.
*Analyze landlord;s burden of proof;
​     -elements of an eviction claim
​     -and availability of Discovery.
The second hour - 'More Advanced and Specialized Issues Relating to Evictions'
*Implied Warranty of Habitability
*More detailed analysis of Constructive Service
*How to count days in notice requirements & service of process
*Repair & Deduct
*Landlord's Duty to Mitigate
*Stay & Expiration of Eviction Orders
