Like a broken record, the Courts continue to monitor all things Covid-19 to try and anticipate what adjustments we need to make. I have no significant Courthouse, docket changes or procedural changes to report at this time. We have been fortunate that many criminal jury trials have been safely conducted without any problems during the pandemic as many Illinois Circuits have not conducted any jury trials since the pandemic began.

Depending on the month, we also have some limited capacity to conduct civil jury trials. Trials involving defendants that are in custody receive priority jury trial settings, so setting jury trials remains fluid to a degree. Judge Costigan and the entire Criminal Division have done an outstanding job of coordinating their respective schedules to ensure that those in custody get a trial setting without delay. 

The Illinois Supreme Court this week entered an Order allowing remote civil jury trials. The Civil Division is reviewing the Order and I am sure you will be hearing more from the Civil Division on that issue. Judge McFarland was part of the Illinois Supreme Court Task-Force Committee involved in getting this Order approved.

The last seven months feels, at times, like seven years and I occasionally find myself thinking that we are living in some sort of alternate universe during the pandemic. Despite all the challenges we have faced and are yet to face, I am confident that all of us collectively are able to persevere and deal with whatever problems come our way. I thank all of you for helping in some way, big or small, to solve the monumental problems that have come our way. 

As we look forward to what may be a unique holiday season, I hope that you are enjoying the change of seasons despite the apparent early winter-like onset we just experienced.

celebration of pro bono week

Last week, the Eleventh Judicial Circuit Pro Bono Committee took part in the national celebration of Pro Bono Week. The committee has organized a reception in past years during Pro Bono Week, but due to COVID-19, it held a virtual event this year. As part of the celebration, the committee premiered a video featuring the chair of the committee, Attorney Carrie Haas, and Illinois Supreme Court Justice Rita Garman thanking all of the pro bono volunteers who have helped those in need over the past year in the Eleventh Circuit. Additionally, representatives from Prairie State Legal Services, The Immigration Project and the Public Interest Law Initiative (PILI) shared details on pro bono opportunities available in the Eleventh Circuit through those organizations. This is the 6th year that the McLean County Bar Association has partnered with the McLean County Nursing Home to adopt residents. This nursing home facility is a high-Medicaid bed nursing home and most of the adopted residents have very low-income. In fact, most of the residents who receive the MCBA gifts might otherwise have no holiday gifts. The staff continues to share heart warming gratitude for all of the generosity given their way through the years! We were able to obtain the names of 50 residents along with their unique wish list for this Holiday Season.

Ms. Kays will provide a CLE on the new Illinois Workplace Transparency Act effective on January 1, 2020 and its requirements, including the mandatory harassment training for employees.
